Purchaser Terms of Service

Effective Date: May 25, 2026

1. Demotect Purchaser Terms of Service

Demotect allows you to access certain premium features, enhanced algorithmic reach, elegant badges, enhanced features, and increased usage quotas for our AI Studio and interactive mapping tools in exchange for payment of a recurring subscription fee (each a “Paid Service” and collectively the "Paid Services").

To the extent that you sign up for and/or use a Paid Service (including our Plus, Pro, Pro+, or Studio tiers), your use of the Paid Services and any corresponding transactions are subject to: (i) the terms and conditions set forth herein (the “Purchaser Terms”), and (ii) the main Terms of Service, Privacy Policy, and all policies incorporated therein (collectively, the “User Agreement”). In the event of a conflict between these Purchaser Terms and the main Terms of Service, these Purchaser Terms shall take precedence solely with respect to your billing and use of the Paid Services.

Contracting Entity: You are entering into these Purchaser Terms with Zysne AB (doing business as Demotect), registered at Ostra Kasernvagen 3c, Vaxholm, Stockholm 18541, Sweden. The words "we," "us," and "our" refer exclusively to Zysne AB.

Acceptance & Age Requirements: By submitting payment and/or clicking a button to initiate a subscription, you expressly agree to be bound by these Terms. To purchase a Paid Service, you must be at least 18 years old or the age of majority in your jurisdiction. If you do not accept all of these terms, you may not use or access the Paid Services.

Jurisdictional Notice: These Terms are bifurcated based on your geographic residence to comply with local laws. Users Outside the EU, EFTA, or the UK (Including the United States) applies to users outside the European Union, EFTA States, and the United Kingdom (including users in the United States). Users in the European Union, EFTA States, or the United Kingdom applies exclusively to users residing within the European Union, EFTA States, or the United Kingdom.

2. Users Outside the EU, EFTA, or the UK (Including the United States)

The following sections apply ONLY if you live outside the European Union, EFTA states, or the United Kingdom.

2.1 Payment Terms, Auto-Renewal & Taxes

Exclusive Payment Processor: We utilize Stripe, Inc. ("Stripe") as our exclusive third-party payment processor. By making a payment, you explicitly agree to abide by Stripe’s relevant terms of service and privacy policies, and you authorize us to share your payment information with Stripe to process payments, prevent fraud, and facilitate dispute resolution. We do not directly store your full credit card number on our servers.

Auto-Renewal Authorization:

BY SIGNING UP FOR A RECURRING PAID SERVICE, YOU EXPRESSLY AUTHORIZE US (VIA STRIPE) TO AUTOMATICALLY CHARGE YOUR SELECTED PAYMENT METHOD ON A RECURRING BASIS (E.G., MONTHLY OR ANNUALLY) AT THE START OF EACH BILLING CYCLE. THIS AUTOMATIC RENEWAL WILL CONTINUE INDEFINITELY UNTIL THE SUBSCRIPTION IS EXPLICITLY CANCELED BY YOU OR TERMINATED BY US.

Payment Method Maintenance: It is your responsibility to ensure your banking, credit card, and payment information is accurate and up to date. If a recurring charge is declined, we may immediately suspend your access to the Paid Services until a valid payment method is provided. We are not responsible for any overdraft fees, foreign exchange fees, or bank charges incurred as a result of your subscription.

Taxes: The listed price for Paid Services may not include applicable local taxes. You are entirely responsible for and agree to pay any applicable sales tax, VAT, GST, duties, or other governmental fees related to your purchase. We may collect and remit these taxes where required by law, and you grant us permission to provide your account data to relevant tax authorities for reporting purposes.

Economic Sanctions & OFAC Compliance: You may not purchase Paid Services if you are a person with whom U.S. or EU persons are prohibited from conducting business pursuant to economic sanctions, including sanctions administered by the US Department of the Treasury's Office of Foreign Assets Control (OFAC). By initiating a transaction, you legally represent and warrant that you are not located in, or ordinarily resident in, a comprehensively sanctioned jurisdiction (e.g., Cuba, Iran, North Korea, Syria, or the Crimea/Donetsk/Luhansk regions).

2.2 Changes to Prices, Tiers, & Features

Our Paid Services evolve constantly. Consequently, we reserve the right to modify, adjust, suspend, or permanently discontinue any Paid Service, subscription tier, or specific feature within a Paid Service (such as AI generation capabilities or map quotas) at our sole discretion, at any time, for any business, financial, or legal reason, without prior liability to you.

Price Adjustments: We reserve the right to change the pricing of our Paid Services or institute new charges at any time. If we increase the price of your recurring subscription, we will provide you with reasonable advance written notice (typically 30 days) via email or a platform notification.

Price changes will take effect at the start of the next subscription period following the date of the price change. If you do not agree with the price increase, your sole and exclusive remedy is to reject the change by canceling your subscription before the new price takes effect. Your continued use of the Paid Services after the price change goes into effect constitutes your legally binding agreement to pay the modified amount.

2.3 Cancellations & "No Refund" Policy

You may cancel your subscription to a Paid Service at any time via the billing portal in your Account Settings.

All Transactions Are Final:

EXCEPT AS EXPRESSLY MANDATED BY APPLICABLE LAW IN YOUR JURISDICTION, ALL PAYMENTS FOR PAID SERVICES ARE ABSOLUTELY FINAL, NON-REFUNDABLE, AND NON-EXCHANGEABLE.

  • No Prorated Refunds: If you cancel your subscription prior to the end of your current billing cycle, your subscription will remain active until the end of that cycle, allowing you to use your remaining quotas. We do not provide prorated refunds or credits for partially used billing periods, unused AI credits, or unused map load quotas.
  • Non-Transferable: Subscriptions are tied strictly to the single Demotect account used at the time of purchase. You may not transfer, gift, or merge Paid Services, credits, or quotas to another account, even if you own both accounts.
  • Account Termination: If your account is suspended or terminated by us due to a violation of our User Agreement (e.g., uploading prohibited content or utilizing scraping bots), you will instantly lose access to your Paid Services and you will not be eligible for any refund for amounts already paid.

2.4 Features, Quotas, and Credits

Certain Paid Services provide access to premium functionalities that incur heavy infrastructural and third-party costs, such as our AI Studio and interactive Global Map. Consequently, these features are strictly metered.

  • AI Credits & Map Loads: Depending on your subscription tier (e.g., Plus, Pro, Pro+, Studio), your account is allocated a specific quota of AI Credits and daily/monthly Map Loads. Generating images of higher quality or resolution consumes more credits per generation.
  • No Rollover & No Cash Value: ALL QUOTAS AND CREDITS RESET AT THE BEGINNING OF EACH BILLING CYCLE. Unused AI Credits, Map Loads, or other metered allocations do not roll over to the next month or billing period. Credits and quotas are virtual, non-transferable usage licenses solely for use within Demotect; they are not currency, cannot be transferred between accounts, and possess absolutely no independent cash value.
  • Overage & Exhaustion: If you exhaust your allocated Map Loads or AI Credits before the end of your current billing cycle, your access to those specific features will be automatically restricted or temporarily suspended until your quota resets, or until you successfully upgrade to a higher subscription tier.

Algorithmic Reach & Third-Party Dependencies:

Algorithmic Reach Disclaimer: Certain Paid Services may advertise "increased reach" or "prioritized visibility" for your posts. You expressly acknowledge and agree that content distribution on Demotect is heavily influenced by probabilistic algorithms, user engagement metrics, and platform safety controls. We make absolutely no representations, warranties, or guarantees regarding a specific number of views, impressions, clicks, or interactions your content will receive.

Third-Party Reliability: The operation of our AI Studio and Global Map relies fundamentally on third-party API providers (including, but not limited to, OpenAI and Mapbox). We disclaim all liability for any degradation in quality, downtime, generation delays, or feature removals resulting from upstream changes, outages, or rate-limiting enforced by these third-party partners. We reserve the right to dynamically adjust resolution limits and AI model parameters to control costs and maintain platform stability.

2.5 Termination for Misuse & Commercial Viability

Your utilization of the Paid Services is inherently contingent upon your strict compliance with the Demotect User Agreement, including our main Terms of Service and Platform Rules.

We reserve the unequivocal right to immediately suspend or permanently terminate your access to the Paid Services, or take any other action we deem appropriate (including permanent account suspension), at any time, without prior notice or liability, for any of the following reasons:

  • We believe, in our sole and absolute discretion, that you have violated the User Agreement or these Purchaser Terms;
  • You bypass, or attempt to bypass, our automated rate limits, DDoS protections, or API security gates;
  • You engage in "jailbreaking," "prompt injection," or other adversarial manipulations of our AI Studio, or use automated scripts to spam map locations or generate content;
  • You upload illicit, copyrighted, or highly explicit material that triggers our automated moderation systems (e.g., AWS Rekognition);
  • Your actions create substantial risk or possible legal exposure for Zysne AB;
  • We are requested or directed to do so by a competent court of law, regulatory authority, or law enforcement agency;
  • Our provision of the Paid Services to you is no longer commercially viable.

FORFEITURE UPON TERMINATION: IF YOUR ACCOUNT OR PAID SERVICE IS SUSPENDED OR TERMINATED DUE TO YOUR BREACH OF THESE TERMS OR THE USER AGREEMENT, YOU WILL IMMEDIATELY LOSE ALL BENEFITS, CREDITS, AND QUOTAS ASSOCIATED WITH YOUR SUBSCRIPTION. YOU EXPRESSLY AGREE THAT YOU WILL NOT BE ELIGIBLE FOR ANY REFUND, PRORATED OR OTHERWISE, FOR ANY AMOUNTS YOU HAVE ALREADY PAID OR PRE-PAID.

2.6 Disclaimers & Limitation of Liability

The Paid Services are Available "AS-IS":

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOUR ACCESS TO AND USE OF THE PAID SERVICES IS AT YOUR OWN SOLE RISK. YOU EXPRESSLY UNDERSTAND AND AGREE THAT THE PAID SERVICES ARE PROVIDED TO YOU ON AN "AS IS" AND "AS AVAILABLE" BASIS. ZYSNE AB (DOING BUSINESS AS DEMOTECT) AND ITS PARENTS, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, AND LICENSORS (COLLECTIVELY, THE "DEMOTECT ENTITIES") EXPRESSLY DISCLAIM ALL WARRANTIES AND CONDITIONS, WHETHER EXPRESS OR IMPLIED, OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

THE DEMOTECT ENTITIES MAKE NO WARRANTY OR REPRESENTATION AND DISCLAIM ALL RESPONSIBILITY AND LIABILITY FOR: (I) THE COMPLETENESS, ACCURACY, AVAILABILITY, TIMELINESS, SECURITY, OR RELIABILITY OF THE PAID SERVICES; (II) ANY HARM TO YOUR COMPUTER SYSTEM, LOSS OF DATA, OR OTHER HARM THAT RESULTS FROM YOUR ACCESS TO OR USE OF THE PAID SERVICES; AND (III) WHETHER THE PAID SERVICES WILL MEET YOUR REQUIREMENTS OR BE AVAILABLE ON AN UNINTERRUPTED, SECURE, OR ERROR-FREE BASIS.

Limitation of Liability:

NOTWITHSTANDING ANY OTHER TERMS TO THE CONTRARY, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE DEMOTECT ENTITIES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE PAID SERVICES; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE PAID SERVICES; (III) ANY CONTENT OR OUTPUT OBTAINED FROM THE PAID SERVICES (INCLUDING AI STUDIO OUTPUTS); OR (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS, CONTENT, OR ACCOUNT.

IN NO EVENT SHALL THE AGGREGATE LIABILITY OF THE DEMOTECT ENTITIES EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (U.S. $100.00) OR THE AMOUNT YOU PAID US, IF ANY, IN THE PAST SIX (6) MONTHS FOR THE PAID SERVICES GIVING RISE TO THE CLAIM.

THE LIMITATIONS OF THIS SUBSECTION SHALL APPLY TO ANY THEORY OF LIABILITY, WHETHER BASED ON WARRANTY, CONTRACT, STATUTE, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, AND WHETHER OR NOT THE DEMOTECT ENTITIES HAVE BEEN INFORMED OF THE POSSIBILITY OF ANY SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

2.7 Dispute Resolution & Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY — IT SIGNIFICANTLY AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY HEAR YOUR CLAIMS.

Initial Dispute Resolution: Most disputes can be resolved informally. Prior to initiating any formal legal proceeding, you agree to contact us in writing at legal@demotect.com. You must provide a brief description of the dispute, your contact information, the email associated with your account, and the specific relief you seek. You and Zysne AB agree to use best efforts to settle any dispute, claim, or controversy through this informal good-faith negotiation process for a period of at least thirty (30) days before initiating formal litigation.

Choice of Law and Forum Selection: The laws of Sweden, excluding its choice of law provisions, will govern these Purchaser Terms and any dispute that arises between you and us, notwithstanding any other agreement between you and us to the contrary. All disputes related to these Terms or the Paid Services will be brought exclusively in the competent courts located in Stockholm, Sweden, and you irrevocably consent to personal jurisdiction in those forums and waive any objection as to inconvenient forum.

Exception for Zysne AB: Without prejudice to the foregoing, you explicitly agree that Zysne AB may, in its sole discretion, bring any claim, cause of action, or dispute we have against you (such as for unpaid fees, DB scraping, or intellectual property theft) in any competent court in the country or state in which you reside that has jurisdiction over the claim.

STATUTE OF LIMITATIONS: YOU AGREE THAT YOU HAVE ONE (1) YEAR TO BRING A CLAIM AGAINST US. You must bring any claim against Zysne AB arising out of or related to these Terms or the Paid Services within one (1) year after the date of the occurrence of the event or facts giving rise to the dispute. If you do not bring a claim within this period, you forever waive the right to pursue any claim or cause of action, and such claims are permanently barred.

CLASS ACTION WAIVER: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU AND ZYSNE AB AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION, COLLECTIVE ACTION, CONSOLIDATED ACTION, OR REPRESENTATIVE PROCEEDING.

Government Entities: If you are a federal, state, or local government entity in the United States using the Paid Services in your official capacity and are legally unable to accept the controlling law, jurisdiction, or venue clauses above, those specific clauses do not apply to you.

3. Users in the European Union, EFTA States, or the United Kingdom

The following sections apply ONLY if you reside in the European Union (EU), the European Free Trade Association (EFTA) states, or the United Kingdom (UK).

3.1 Payment Terms, Auto-Renewal & Taxes

Exclusive Payment Processor: We utilize Stripe, Inc. ("Stripe") as our exclusive third-party payment processor. By purchasing a Paid Service, you explicitly agree to abide by Stripe’s relevant terms of service and privacy policies, and you authorize us to share your payment information with Stripe to process payments, prevent fraud, and facilitate dispute resolution.

Auto-Renewal Authorization: By signing up for a recurring Paid Service, you expressly agree that your subscription will automatically renew at the end of each billing period (e.g., monthly or annually). You authorize us (via Stripe) to automatically charge your selected payment method for the recurring subscription fee until you actively cancel the subscription.

Payment Method Maintenance: It is your responsibility to ensure your banking, credit card, and payment information is accurate and up to date. If a recurring charge is declined, we reserve the right to temporarily suspend your access to the Paid Services until a valid payment method is provided.

Taxes (VAT): For users residing in the EU or UK, the price of the Paid Services displayed at the final checkout includes all applicable Value Added Tax (VAT) or similar local taxes, in compliance with your local jurisdiction's tax laws. You grant us permission to provide your account data to relevant tax authorities to fulfill our statutory tax collection and reporting obligations.

3.2 Changes to Prices, Tiers, & Features

Our platform and Paid Services evolve constantly. In compliance with EU law, we may revise, update, or modify our Paid Services (including API quotas, AI generation limits, and map features) or increase subscription prices from time to time based on valid and reasonable grounds.

Valid and Reasonable Grounds: Such grounds include, but are not limited to: (i) changes in the costs relating to operation, maintenance, and third-party provision (e.g., AWS, OpenAI or Mapbox API cost increases); (ii) technical, security-related, or operational developments; (iii) compliance with a changed legal situation, statutory fees, or regulatory orders; and (iv) the optimization of the user experience through the implementation of new features.

Notice and Your Right to Terminate: If we make a material change to the core functionality of a Paid Service or increase your recurring subscription price, we will notify you in writing (via email or a service notification) at least thirty (30) days in advance of the change taking effect.

The notification will clearly specify the characteristics of the change, the effective date, and inform you of your right to terminate the subscription. If you do not agree to the price increase or material change, you have the right to reject it by canceling your subscription before the new change takes effect. If you do not cancel your subscription and continue to use the Paid Services after the 30-day deadline has expired, you legally agree to be bound by the revised changes and/or increased pricing.

3.3 Cancellations & Statutory Right of Withdrawal

Standard Cancellation: You may cancel your subscription to a Paid Service at any time via the billing portal in your Account Settings. Your subscription will remain active from the time you cancel until the end of your current paid billing period. We do not provide prorated refunds or credits for any remaining days in your current subscription period.

14-Day Right of Withdrawal & Explicit Waiver:

Under the European Union Consumer Rights Directive, if you are a consumer residing in the EU, EFTA, or the UK, you generally have a statutory right to withdraw from a digital purchase contract within fourteen (14) days of purchase for any reason, and receive a full refund.

HOWEVER, BY PURCHASING A PAID SERVICE (E.G., PLUS, PRO, PRO+, OR STUDIO TIERS), YOU EXPRESSLY CONSENT TO THE IMMEDIATE PERFORMANCE OF THE CONTRACT AND IMMEDIATE SUPPLY OF THE DIGITAL CONTENT AND SERVICES BEFORE THE WITHDRAWAL PERIOD HAS EXPIRED.

WAIVER OF STATUTORY RIGHT: You acknowledge and legally agree that the moment you utilize a premium feature (including, but not limited to, generating an AI image, utilizing premium Map Loads, or publishing a post with enhanced algorithmic reach), the digital service is deemed to have been fully performed, and you irrevocably lose and waive your statutory right of withdrawal and right to a refund.

If you have purchased a Paid Service but have strictly not utilized any premium features, credits, or quotas, and wish to exercise your right of withdrawal within the 14-day window, you must inform us of your decision by submitting a clear, written statement to our support team at support@demotect.com or using this form before the 14-day period expires.

3.4 Features, Quotas, and Credits

Certain Paid Services provide access to premium functionalities that inherently rely on metered infrastructure and third-party sub-processors (e.g., our AI Studio and interactive Global Map). By purchasing a Paid Service, you acknowledge that the service is strictly subject to the following usage characteristics:

  • AI Credits & Map Loads: Your subscription tier (e.g., Plus, Pro, Pro+, Studio) dictates your specific allocation of AI Credits and daily/monthly Map Loads. Generating images at higher resolutions or qualities consumes proportionately more credits per generation, as detailed on our pricing page.
  • No Rollover & No Cash Value: All quotas and credits are provided on a periodic basis and reset at the beginning of each billing cycle. Unused AI Credits, Map Loads, or other metered allocations expire at the end of the billing period and do not roll over. Quotas and credits are purely virtual, non-transferable usage licenses enabling access to Demotect features; they do not constitute electronic money, cannot be transferred to other users, and possess absolutely no independent cash value.
  • Overage & Exhaustion: If you exhaust your allocated Map Loads or AI Credits before the end of your current billing cycle, your access to those specific premium features will be automatically restricted or temporarily suspended until your quota resets, or until you manually upgrade to a higher tier.

Algorithmic Reach & Third-Party Dependencies:

Algorithmic Reach Transparency: Certain Paid Services may include "increased reach" or "prioritized visibility" features. You acknowledge that content distribution on Demotect is governed by probabilistic algorithms, user engagement metrics, and our automated safety controls. While premium tiers amplify your potential distribution, we do not guarantee any specific number of views, impressions, clicks, or interactions, and failure to achieve specific metrics does not constitute a defect in the Paid Service.

Third-Party Availability: The core functionalities of our AI Studio and Global Map are reliant on third-party service providers (including, but not limited to, OpenAI and Mapbox). While we strive to provide uninterrupted service, you agree that we are not liable for temporary service degradations, generation delays, or downtime caused by unexpected outages, rate-limiting, or upstream changes enforced by these critical third-party partners that are beyond our reasonable control.

3.5 Termination for Misuse & Commercial Viability

Your access to and utilization of the Paid Services is strictly contingent upon your continuous compliance with the Demotect User Agreement, including our main Terms of Service and Platform Rules.

We reserve the right to suspend or permanently terminate your access to the Paid Services, or take any other appropriate enforcement action against your account, for objective and reasonable grounds. Such grounds for immediate termination without prior notice include situations where:

  • We have valid reason to believe you have materially breached the User Agreement or these Purchaser Terms;
  • You bypass, or attempt to bypass, our automated rate limits, DDoS protections, or API security gates;
  • You engage in "jailbreaking," "prompt injection," or other adversarial manipulations of our AI Studio, or deploy unauthorized automated scripts to interact with our platform;
  • You upload or generate explicitly illicit, highly violent, or illegal material (such as CSAM), prompting automated or manual enforcement in compliance with the EU Digital Services Act (DSA);
  • We are legally mandated to do so by a competent court of law, regulatory authority, or law enforcement agency;
  • Your actions create a demonstrable security risk or substantial legal exposure for Zysne AB.

Furthermore, we reserve the right to terminate your subscription upon reasonable advance notice if our provision of the Paid Services (in whole or in part) to you is no longer commercially viable.

FORFEITURE UPON TERMINATION FOR BREACH: IF YOUR ACCOUNT OR PAID SERVICE IS SUSPENDED OR TERMINATED DUE TO YOUR MATERIAL BREACH OF THESE TERMS OR THE USER AGREEMENT (E.G., UPLOADING ILLEGAL CONTENT OR SCRAPING), YOU WILL IMMEDIATELY LOSE ALL BENEFITS, CREDITS, AND QUOTAS ASSOCIATED WITH YOUR SUBSCRIPTION. TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOU AGREE THAT YOU WILL NOT BE ELIGIBLE FOR ANY REFUND, PRORATED OR OTHERWISE, AS SUCH PRE-PAID AMOUNTS SHALL BE RETAINED BY US AS LIQUIDATED DAMAGES FOR YOUR BREACH.

3.6 Limitation of Liability & Statutory Guarantees

Statutory Rights: As a consumer in the EU, EFTA, or the UK, you benefit from mandatory statutory warranties and guarantees regarding the supply of digital content and digital services. Nothing in these Purchaser Terms shall restrict, exclude, or modify these mandatory statutory rights.

Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ZYSNE AB (DOING BUSINESS AS DEMOTECT) AND ITS ENTITIES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE PAID SERVICES; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE PAID SERVICES; OR (III) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS, CONTENT, OR ACCOUNT.

IN NO EVENT SHALL THE AGGREGATE LIABILITY OF ZYSNE AB EXCEED THE GREATER OF ONE HUNDRED EUROS (€100.00) OR THE AMOUNT YOU PAID US, IF ANY, IN THE PAST SIX (6) MONTHS FOR THE PAID SERVICES GIVING RISE TO THE CLAIM.

Mandatory Legal Exceptions:

APPLICABLE LAW IN YOUR JURISDICTION MAY NOT ALLOW FOR CERTAIN LIMITATIONS OF LIABILITY. CONSEQUENTLY, THE ABOVE LIMITATIONS DO NOT LIMIT ZYSNE AB’S LIABILITY FOR (A) DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE; (B) FRAUD OR FRAUDULENT MISREPRESENTATION; (C) DAMAGES CAUSED BY OUR INTENTIONAL MISCONDUCT OR GROSS NEGLIGENCE; OR (D) BREACH OF ESSENTIAL CONTRACTUAL OBLIGATIONS (CARDINAL DUTIES), IN WHICH CASE OUR LIABILITY SHALL BE LIMITED TO THE FORESEEABLE DAMAGE TYPICAL FOR THIS TYPE OF CONTRACT.

3.7 Dispute Resolution, Governing Law & Jurisdiction

Initial Dispute Resolution: If you experience an issue with your Paid Services, we encourage you to contact our support team at support@demotect.com or using this form. We strive to resolve all billing and technical disputes amicably and expeditiously without the need for formal legal proceedings.

Governing Law: These Purchaser Terms shall be governed by and construed in accordance with the laws of Sweden. However, if you are a consumer residing in the EU, EFTA, or the UK, this choice of law does not deprive you of the protection afforded to you by provisions that cannot be derogated from by agreement by virtue of the mandatory consumer protection laws of your country of habitual residence.

Jurisdiction: As a consumer, you may bring any judicial proceedings relating to these Terms before the competent court of your place of residence or the competent court in Stockholm, Sweden. If Zysne AB wishes to enforce any of its rights against you as a consumer, we may do so only in the courts of the jurisdiction in which you reside.

Time Limitations: You must bring any claim against Zysne AB arising out of or related to these Terms within one (1) year after the date of the occurrence of the event giving rise to the dispute, unless applicable law in your jurisdiction provides that the normal statute of limitations for that claim may not be shortened by agreement.

Alternative Dispute Resolution (ADR) & ODR:

If we cannot resolve a dispute directly, you have the right to utilize Alternative Dispute Resolution. The European Commission provides an Online Dispute Resolution (ODR) platform, accessible at https://ec.europa.eu/consumers/odr.

Furthermore, as Zysne AB is registered in Sweden, you may submit complaints to the Swedish National Board for Consumer Disputes (Allmänna reklamationsnämnden - ARN) located at Box 174, 101 23 Stockholm, Sweden, or via their website at www.arn.se. Zysne AB is legally committed to participating in dispute resolution procedures before this consumer arbitration board.
