1. Agreement to our Legal Terms

We are Zysne AB (doing business as Demotect) ("Company," "we," "us," or "our"), registered in Stockholm, Sweden.

These Terms of Service ("Terms"), together with our Rules (https://demotect.com/help/rules-and-policies/rules) which are expressly incorporated by reference herein, constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you", "your"), and us, governing your relationship with us and your and other users' access to and use of, and anything otherwise relating to, our or our corporate affiliates' services, including our various websites, APIs, CDNs, email notifications, SMS, applications, buttons, widgets, ads, commerce services, paid products and services, and our other covered services that link to these Terms (collectively, the "Services"), and any information, text, links, graphics, photos, images, audio, videos, AI generated text and files, maps, or other materials or arrangements of materials uploaded, downloaded or appearing on the Services (collectively referred to as "Content").

By accessing the Services, you agree that you have read, understood, and agreed to be bound by all of these Terms. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND MUST DISCONTINUE USE IMMEDIATELY.

We reserve the right, in our sole discretion, to make changes or modifications to these Terms at any time. We will alert you about any material changes by updating the "Effective Date" of these Terms, and via a service notification if you are an active account holder. Your continued use of the Services after the date such revised Terms are posted constitutes your acceptance of the changes.

2. Who May Use the Services

You may use the Services only if you agree to form a binding contract with us and are not a person barred from receiving services under the laws of your applicable jurisdiction.

Age Restriction: In any case, you must be at least 13 years old to use the Services. If the law of your country requires you to be older in order for us to lawfully provide the Services to you without parental consent (for example, 16 years old in certain European Union member states to comply with the GDPR), then you must be that older age.

Corporate Entities: If you are accepting these Terms and using the Services on behalf of a company, organization, government, or other legal entity, you represent and warrant that you are authorized to do so and have the authority to bind such entity to these Terms.

3. Privacy & Data Protection

Our Privacy Policy (https://demotect.com/help/rules-and-policies/privacy) and Cookie Policy (https://demotect.com/help/rules-and-policies/cookies) describe how we handle the information you provide to us when you use the Services. You understand that through your use of the Services, you consent to the collection and use of this information, including the transfer of this information to Ireland, the United States, and other countries for storage, processing, and use by us and our authorized affiliates in accordance with our Privacy Policy.

4. Content on the Services

You are solely responsible for your use of the Services and for any Content you provide, upload, submit, input, create, generate, post, display, or otherwise utilize, including images, map pins, captions, AI inputs, prompts, outputs, and any information obtained or created through the platform.

It is your strict responsibility to ensure that your Content complies with all applicable laws, rules, policies, and regulations. Any use or reliance on any Content or materials posted via the Services or obtained by you through the Services is at your own risk. We do not endorse, support, represent, or guarantee the completeness, truthfulness, accuracy, or reliability of any Content or communications posted via the Services. You understand that by using the Services, you may be exposed to Content that might be offensive, harmful, inaccurate, or otherwise inappropriate.

4.1 Your Rights & The Broad License You Grant Us

What’s yours is yours. You retain full ownership and all intellectual property rights to any original Content (including incorporated audio, text, photos, and videos) you provide, upload, submit, input, create, generate, post, or display on or through the Services.

However, by deciding to provide, submit, upload, input, create, generate, post, or otherwise display Content on or through our Services, you grant us a worldwide, non-exclusive, perpetual, irrevocable, royalty-free license (with the right to freely sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, display, upload, download, and distribute such Content, including anything referenced therein, in any and all media, formats, or distribution methods now known or later developed, for any purpose. For the sake of clarity, these rights include, but are not limited to, curating, transforming, formatting, and translating your Content.

Machine Learning, AI & Syndication: You expressly agree that this comprehensive license includes the right for us to:

  • Analyze text, images, geodata, and other information you provide with the view to provide, promote, and improve the Services;
  • Utilize your Content for the research, development, training, fine-tuning, and overall improvement of our machine learning systems and artificial intelligence models;
  • Make your Content available to other companies, organizations, or individuals for the syndication, broadcast, distribution, reposting, promotion, or publication of such Content on other media and services.

You explicitly agree that these aforementioned uses by us, our affiliates, or third-party ecosystem partners are made without any financial compensation paid to you. You acknowledge and agree that your access to and use of the Services constitutes full, fair, and sufficient compensation for the Content and the comprehensive rights you grant us herein.

4.2 User Warranties and Permissions

You represent and warrant that you have, or have obtained, all rights, licenses, consents, permissions, power, and authority necessary to grant the sweeping rights granted herein for any Content that you provide, submit, upload, input, create, generate, post, or otherwise display on or through the Services. You agree and warrant that your Content does not contain material subject to third-party copyright, trademark, privacy, or other proprietary rights, unless you have obtained the express, legal permissions required to post the material and to grant us the worldwide license described above.

4.3 Image Credits & Third-Party Content

If you are uploading images that you did not personally create (e.g., historical archive photos, third-party renders, or stock imagery), you must use the platform's provided Copyright & Attribution tools to shield both yourself and Demotect from liability.

  • You must accurately declare the license type governing the image (e.g., Public Domain, Creative Commons, Explicit Permission, or a statutory exception).
  • You must provide the name of the original rights holder and a valid URL linking to the original source, as legally required by standard open licenses such as CC-BY.
  • Failure to properly attribute copyrighted works or repeatedly submitting infringing material will result in the removal of your Content, a strike against your account, and potential legal exposure. To the maximum extent permitted by applicable law, you agree to fully indemnify and hold us harmless from any claims, damages, or legal costs arising directly from your infringing uploads.

4.4 AI Studio, Generated Content & EU AI Act

Demotect provides an AI Studio allowing you to re-render imagery and photography using artificial intelligence.

  • Ownership of Outputs: Subject to your full compliance with these Terms, we assign to you all our right, title, and interest in and to the Content generated by the AI based on your inputs.
  • Nature of Machine Learning: Due to the probabilistic nature of AI, generated Content may not be unique across users, and similar prompts may yield similar results. We make no representations or warranties regarding the accuracy, structural integrity, originality, or factual suitability of AI-generated images.
  • Transparency & Compliance (Article 50): To combat misinformation and comply with transparency laws, including Article 50 of the European Union AI Act (Regulation (EU) 2024/1689), any photorealistic image generated in its entirety by AI, or a real photo heavily manipulated by generative AI using our AI Studio or an external tool, must be accurately labeled using the platform's "AI Generated" flag toggle when creating and publishing posts.

4.5 Content Moderation & EU DSA Enforcement

Platform Rules: We reserve the unequivocal right to remove Content that violates our Rules or these Terms at our sole discretion, including, but not limited to, copyright misappropriation, impersonation, unlawful conduct, harassment, or spam.

Automated Safety Scanning: To protect our community, uploaded media and text may be automatically scanned by proprietary or third-party moderation systems. Content detected as containing extreme violence, non-consensual explicit material, or illegal acts is subject to instant rejection and deletion.

DSA Article 14 (Terms and Conditions): In accordance with the Digital Services Act (Regulation (EU) 2022/2065), your Content may be subject to restrictions, shadow-banning, geo-blocking, or permanent removal based on our algorithmic moderation policies, human review, or orders from competent regulatory authorities if the content is deemed illegal or incompatible with our policies.

Redress (Articles 17, 20 & 21): If we restrict your content or suspend your account, you will be provided with a Statement of Reasons outlining the restriction. You will have access to an internal complaint-handling system to appeal the decision, and where applicable, access to certified out-of-court dispute settlement bodies to resolve moderation disputes without prejudice to your right to seek judicial redress.

6. Using the Services & Prohibited Activities

We aim to keep Demotect a secure, high-quality environment for everyone. By using the Services, you agree to comply with our Rules and all applicable laws.

The Services evolve constantly. As such, the Services may change from time to time, at our sole discretion. We may stop (permanently or temporarily) providing the Services or any features within the Services to you or to users generally. We retain the right to create limits on use, bandwidth, and storage at our sole discretion at any time without prior notice or liability to you.

6.1 Your License to Use the Services

We grant you a personal, worldwide, royalty-free, non-assignable, and non-exclusive license to use the software provided to you as part of the Services. This license has the sole purpose of enabling you to use and enjoy the benefit of the Services as provided by Demotect, in the manner permitted by these Terms.

Our Intellectual Property: The Services are protected by copyright, trademark, and other laws of the European Union, Sweden, and other countries. Nothing in these Terms gives you a right to use the Demotect name or any of our trademarks, logos, domain names, or other distinctive brand features. All right, title, and interest in and to the Services (excluding user-provided Content) are and will remain the exclusive property of Zysne AB and its licensors.

Feedback: Any feedback, comments, or suggestions you may provide regarding Demotect or the Services is entirely voluntary, and we will be free to use such feedback, comments, or suggestions as we see fit and without any obligation or compensation to you.

6.2 Strictly Prohibited Conduct & Misuse

You agree not to misuse the Services or help anyone else do so. You agree that you will not work around any technical limitations in the software, or reverse engineer, decompile, or disassemble the software, except to the extent that applicable law expressly permits. While accessing or using the Services, you strictly may not do any of the following:

  • System Tampering: Access, tamper with, or use non-public areas of the Services, our internal computer systems, or the technical delivery systems of our providers.
  • Vulnerability Probing: Probe, scan, or test the vulnerability of any system, network, or server, or breach or circumvent any security or authentication measures.
  • Unauthorized Access & Scraping: Access, search, or attempt to access or search the Services by any means (automated or otherwise) other than through our currently available, published interfaces. Crawling, scraping, or data-mining the Services in any form, for any purpose, without our express prior written consent is strictly prohibited.
  • AI & System Manipulation: Attempt to circumvent, manipulate, or disable systems and Services, including through "jailbreaking," "prompt injection," or other adversarial methods intended to override or manipulate safety, security, or platform controls in our AI Studio or elsewhere.
  • Deceptive Transmissions: Forge any TCP/IP packet header or any part of the header information in any email or posting, or in any way use the Services to send altered, deceptive, or false source-identifying information.
  • Disruption & Abuse: Interfere with, or disrupt (or attempt to do so), the access of any user, host, or network, including sending viruses, overloading, flooding, spamming, mail-bombing the Services, or artificially inflating engagement metrics using click-farms or bots.
  • Scripted Burden: Script the creation of Content (including automated post generation or AI rendering) in such a manner as to interfere with or create an undue burden on the Services' infrastructure.

6.3 Map Accuracy & Community Proposals

Our Global Map relies on accurate geodata to provide a high-quality exploration experience.

  • No Malicious Pinning: You agree to provide accurate geographical locations for your posts. Intentionally placing posts in incorrect cities, countries, or coordinates to spam the map is a direct violation of these Terms.
  • Community Corrections: If a post is inaccurately mapped, users may submit a "Location Correction Proposal." If accepted by consensus, the post is automatically moved to the correct location.
  • Reputation Impacts: Repeatedly posting inaccurate locations will negatively impact your Trust Score and may result in the suspension of your mapping privileges.

6.4 Right to Suspend, Terminate, or Restrict

We may suspend or terminate your account, or cease providing you with all or part of the Services, at any time if we reasonably believe: (i) you have violated these Terms or our Rules; (ii) you create risk or possible legal exposure for us; (iii) your account should be removed due to unlawful conduct; (iv) your account should be removed due to prolonged inactivity; or (v) our provision of the Services to you is no longer commercially viable.

Account Deletion: You may end your legal agreement with us at any time by deactivating your account. Deactivated accounts enter a 30-day grace period. During this time, your profile and Content are hidden from the public, but the account is not yet erased. Once 30 days have passed, your account and data are permanently deleted. Please note that certain provisions of these Terms (including intellectual property licenses, limitations of liability, and liquidated damages) survive account termination.

6.5 Anti-Scraping & Liquidated Damages

Protecting our users' data and our system resources is a critical priority. You agree that, to the extent permitted by applicable law, if you violate these Terms by scraping, crawling, or utilizing unauthorized automated tools, or if you induce or knowingly facilitate others to do so, in addition to all other legal remedies available to us, you will be jointly and severally liable to us for liquidated damages.

For commercial or business entities requesting, viewing, or accessing more than 1,000,000 posts (including images, comments, and geodata) in any 24-hour period via unauthorized automated means, you agree to pay €15,000 EUR per 1,000,000 posts.

You agree that these amounts are a reasonable estimate of our damages, not a penalty, and do not otherwise limit our ability to recover from you or seek injunctive or equitable relief. Consumer Exemption: For consumers residing in the EU or UK, this liquidated damages provision does not apply, and we instead reserve the right to claim actual damages in accordance with applicable statutory law.

7. Premium Subscriptions & Billing

Demotect offers optional paid subscription tiers (e.g., Plus, Pro, Pro+, Studio) that grant access to enhanced features, higher usage limits, and exclusive profile badges.

Purchaser Terms: If you utilize, subscribe to, or pay for any premium features, products, or services on Demotect, you expressly agree to our applicable Purchaser Terms, which become part of our binding legal agreement with you. In the event of a conflict between these Terms of Service and the Purchaser Terms, the Purchaser Terms will take precedence regarding your use of those specific paid services.

7.1 Payments & Auto-Renewal

By selecting a Premium plan, you agree to pay the recurring fees associated with that plan securely processed through our provider (e.g., Stripe).

  • Auto-Renewal: By subscribing and completing payment, you affirmatively consent to the automatic renewal of your subscription at the end of each billing period.
  • Price Changes: We reserve the right to change subscription pricing with reasonable prior notice (typically 30 days). Continued use after the price change takes effect constitutes your agreement to pay the modified amount.

7.2 Usage Quotas & Credits

Certain features incur heavy infrastructural costs and are metered.

  • Map Loads: Free accounts are provided a strict daily quota for interactive map tile loads. Premium tiers increase this allowance significantly.
  • AI Credits: Generating images in the AI Studio consumes AI Credits based on output quality. Unused credits do not roll over to the next month unless otherwise explicitly stated.
  • Overage: Exhausting your quotas will temporarily suspend access to those specific features until your cycle resets or you upgrade tiers.

7.3 Cancellations & Refunds

You may cancel your subscription at any time through your Account Settings. Cancellation takes effect at the end of the current paid billing period. All payments are generally non-refundable, and we do not provide refunds or credits for partial subscription periods or unused credits.

EU Statutory Right of Withdrawal: If you reside in the European Union, the Consumer Rights Directive (2011/83/EU) grants you a statutory right to withdraw from the contract within 14 days of purchase without giving any reason. However, by subscribing to our digital services, you expressly consent to the immediate performance of the contract and acknowledge that you lose your right of withdrawal as soon as you begin utilizing the premium features (e.g., generating an AI image, utilizing premium map loads, or downloading premium assets).

8. Disclaimers and Limitations of Liability

Please read this section carefully as it limits the liability of Demotect and its parent company, Zysne AB, for both free and paid users.

8.1 The Services are Available "AS-IS"

Your access to and use of the Services or any Content are at your own sole risk. You understand and agree that the Services are provided to you on an "AS IS" and "AS AVAILABLE" basis.

To the maximum extent permitted under applicable law, ZYSNE AB AND ITS ENTITIES EXPRESSLY DISCLAIM ALL WARRANTIES AND CONDITIONS, WHETHER EXPRESS OR IMPLIED, OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

  • We make no warranty or representation and disclaim all responsibility and liability for the completeness, accuracy, availability, timeliness, security, or reliability of the Services or any Content.
  • AI & Mapping: We explicitly disclaim liability for the factual accuracy of any geodata, map rendering, or architectural structural integrity of any output generated by our AI Studio.
  • We take no responsibility for any harm to your computer system, loss of data, or other harm that results from your access to or use of the Services.
  • We are not responsible for the deletion of, or the failure to store or to transmit, any Content, images, or communications maintained by the Services.

8.2 Limitation of Liability

NOTWITHSTANDING ANY OTHER TERMS TO THE CONTRARY, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ZYSNE AB AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, INCOME, ANTICIPATED SAVINGS, FOLLOWERS, OR BRAND VALUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

THIS LIMITATION APPLIES TO DAMAGES RESULTING FROM:
(I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES;
(II) ANY CONDUCT OR CONTENT OF ANY USER OR THIRD PARTY ON THE SERVICES, INCLUDING WITHOUT LIMITATION, ANY DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF OTHER USERS OR THIRD PARTIES;
(III) ANY CONTENT OR OUTPUT OBTAINED FROM THE SERVICES (INCLUDING AI STUDIO OUTPUTS); OR
(IV) UNAUTHORIZED ACCESS BY THIRD PARTIES (INCLUDING HACKING, ACCOUNT TAKEOVERS, OR DATA BREACHES), USE, OR ALTERATION OF YOUR TRANSMISSIONS, CONTENT, OR ACCOUNT.

IN NO EVENT SHALL THE AGGREGATE LIABILITY OF ZYSNE AB EXCEED THE GREATER OF ONE HUNDRED EUROS (€100.00) OR THE AMOUNT YOU PAID US, IF ANY, IN THE PAST SIX (6) MONTHS FOR THE SERVICES GIVING RISE TO THE CLAIM.

Mandatory Exceptions (EU/UK/EFTA Users): Applicable law in your jurisdiction may not allow for certain limitations of liability. To the extent required by mandatory applicable law, the above does not limit our liability for fraud, fraudulent misrepresentation, death or personal injury caused by our negligence, or damages caused by our gross negligence or intentional misconduct.

9. Dispute Resolution & General Terms

The following provisions govern our overall legal relationship, how disputes are resolved, and how these Terms are interpreted.

9.1 Governing Law and Jurisdiction

For Users Outside the EU, EFTA, or the UK (Including the US): These Terms, and any dispute that arises between you and us, shall be governed by and defined following the laws of Sweden, without regard to its conflict of law provisions. You irrevocably consent that the courts of Stockholm, Sweden shall have exclusive jurisdiction to resolve any dispute. Exception: Zysne AB may, in its sole discretion, bring any claim or dispute against you in any competent court in the country in which you reside that has jurisdiction over the claim.

For Users in the EU, EFTA, or the UK: These Terms shall be governed by the laws of Sweden. However, this choice of law does not deprive you of the protection afforded to you by mandatory consumer protection laws of your country of residence. You may bring judicial proceedings relating to these Terms before the competent court of your place of residence or the competent court in Stockholm, Sweden. If we enforce our rights against you as a consumer, we may do so only in the courts of the jurisdiction in which you reside.

9.2 Class Action Waiver & Statute of Limitations

CLASS ACTION WAIVER: TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AND ZYSNE AB AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION, COLLECTIVE ACTION, CONSOLIDATED ACTION, OR REPRESENTATIVE PROCEEDING.
EU Consumer Exemption: For consumers residing in the EU, this waiver does not affect your statutory right to participate in representative actions brought by qualified entities under Directive (EU) 2020/1828.

1-YEAR TIME LIMIT: You must initiate any proceeding or action arising out of or related to these Terms or the Services within one (1) year of the date of the occurrence of the event giving rise to the dispute, unless applicable law in your jurisdiction provides that the normal statute of limitations for that claim may not be shortened by agreement. Otherwise, you forever waive the right to pursue any claim or cause of action.
EU Consumer Exemption: For consumers residing in the EU, the statutory limitation periods prescribed by your local law (such as the 3-year period in Sweden) shall apply instead.

9.3 Modifications and Interruptions

We cannot guarantee the Services will be available at all times. We may experience hardware, software, or other problems resulting in interruptions, delays, or errors. We reserve the right to change, revise, update, suspend, discontinue, or otherwise modify the Services at any time or for any reason without notice to you. You agree that we have no liability whatsoever for any loss, damage, or inconvenience caused by your inability to access or use the Services during any downtime.

9.4 Severability and Language

In the event that any provision of these Terms is held to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms will remain in full force and effect. The Demotect User Agreement is written in English. In case of any discrepancies or inconsistencies with translated versions, the English language version shall take precedence.

9.5 Single Point of Contact (DSA Articles 11 & 12)

Under the EU Digital Services Act, our designated Single Point of Contact for communications with Member State authorities, the European Commission, the European Board for Digital Services, and our users is legal@demotect.com. Communications must be in English or Swedish.
